Terms of Service

1. Introduction
Welcome to Service Storm, LLC ("Service Storm", "we", "us", or "our"). These Terms of Service ("TOS") govern your access to and use of the Service Storm application (the "App") and all related services, including any updates, new features, or enhancements (collectively, the "Services"). By accessing or using the Services, you agree to comply with and be bound by these TOS. If you do not agree to these terms, you may not use the Services.
2. Eligibility
By using the Services, you affirm that you are at least 18 years of age or the legal age of majority in your jurisdiction, and have the legal capacity to enter into a contract. If you are using the Services on behalf of a business or entity, you represent that you have the authority to bind that business or entity to these TOS.
3. Account Registration
To access certain features of the Services, you must create an account with Service Storm. You agree to provide accurate, complete, and current information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. User Responsibilities
You agree to:
- Use the Services in compliance with all applicable laws and regulations.
- Provide accurate, complete, and current information when required.
- Keep your account and login credentials secure.
- Not engage in any unauthorized use of the Services, including accessing or attempting to access data or systems without authorization.
- Not use the Services for any unlawful, harmful, or malicious activities.
5. Payment Terms
Certain features of the Services may require payment, including but not limited to lead purchases, subscriptions, or premium features. By making a purchase, you agree to pay the applicable fees for such services, as outlined at the time of purchase. All payments will be processed through a third-party payment provider, such as Stripe. You agree to comply with the terms and conditions of these providers.
6. Privacy and Data Protection
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Services, you consent to the collection and use of your data in accordance with our Privacy Policy.
7. Termination
Service Storm reserves the right to suspend or terminate your access to the Services at its sole discretion, without notice, for any reason, including but not limited to a violation of these TOS. Upon termination, all rights and licenses granted to you will immediately cease. You may terminate your account by contacting us at support@servicestorm.com. Termination of your account will result in the loss of access to the Services, but any outstanding fees will remain due.
8. Disclaimers
The Services are provided "as-is" and "as available," without any warranties or representations, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Service Storm does not guarantee that the Services will be error-free, uninterrupted, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, Service Storm, its affiliates, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Services, even if Service Storm has been advised of the possibility of such damages. Our total liability to you for any claims arising from or related to these TOS or the Services will be limited to the amount you have paid for the Services in the 12-month period immediately preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Service Storm, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from or in connection with your use of the Services or any violation of these TOS.
11. SMS Text Messaging
By creating an account with Service Storm and providing your mobile phone number, you expressly consent to receive SMS text messages from us related to support requests, service updates, and other account-related communications.
Consent and Opt-In
You provide consent to receive SMS messages in the following ways:
- By creating an account and submitting your phone number during registration
- By submitting a support request through our web application and providing your phone number
- By texting our published support number, which constitutes automatic consent to receive support-related messages
Types of Messages
You may receive SMS messages including but not limited to:
- Support request confirmations and updates
- Service appointment reminders and notifications
- Account status updates
- Important service-related communications
Message Frequency and Charges
Message frequency varies based on your account activity and support requests. Message and data rates may apply based on your mobile carrier's plan. Service Storm is not responsible for any charges you may incur from your mobile carrier.
Opt-Out and Help
You may opt out of receiving SMS messages at any time by:
- Replying STOP to any SMS message you receive from us
- Contacting our support team at support@servicestorm.com
For assistance with SMS messages, reply HELP to any message or contact us at support@servicestorm.com.
Carrier Participation
Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and other major U.S. carriers. Service Storm is not liable for delayed or undelivered messages caused by your mobile carrier or service provider.
12. Changes to the Terms of Service
Service Storm reserves the right to update or modify these TOS at any time. We will notify you of material changes by posting the revised TOS on this page and updating the effective date. Your continued use of the Services after such changes will constitute your acceptance of the updated TOS.
13. Governing Law and Dispute Resolution
These TOS are governed by the laws of the state of Utah, United States, without regard to its conflict of laws principles. Any disputes arising from or related to these TOS or the Services will be resolved through binding arbitration in Salt Lake City, Utah, in accordance with the rules of the American Arbitration Association.
14. Miscellaneous
If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These TOS, along with our Privacy Policy and any other legal notices, constitute the entire agreement between you and Service Storm with respect to the Services. You may not assign or transfer your rights under these TOS without our prior written consent. Service Storm may assign its rights without restriction.
